Asbestos Compliance Framework Review | Have Your Say Before 26 April 2026

Safe Work Australia has opened public consultation on the Asbestos Framework Review, examining how the model WHS framework can be strengthened to better control asbestos risks and support the prioritised removal of asbestos-containing materials (ACMs).

This review directly supports the Asbestos National Strategic Plan and will inform national updates to WHS laws, regulations, codes of practice and guidance, with recommendations to Safe Work Australia Members expected in late 2026.

Who should submit?

If you work in asbestos removal, construction, demolition, property management, or WHS consulting, your practical experience matters. Safe Work Australia is specifically seeking feedback from:

• Asbestos removalists and assessors
• Construction and demolition businesses
• WHS professionals and health and safety representatives
• Employers and workers who manage asbestos in workplaces

Why asbestos compliance submissions matter

Gaps in the current asbestos compliance framework – including inconsistent penalties for unlicensed removal, fragmented licence registers, and low public awareness of how to verify contractor credentials – continue to result in preventable exposures. Evidence-based submissions from industry professionals directly shape whether these gaps are addressed in the final reforms.

Back in December 2025, we highlighted the case of JC Asbestos Removalist in WA – a repeat offender prosecuted twice within months for conducting unlicensed asbestos removal work at residential properties. That case is a clear example of why the current framework needs strengthening. HSE Direct has since lodged a formal submission to this review raising concerns about repeat offenders, inadequate deterrence penalties, and the need for a single national licence register.
